What is a Deposition?

When individuals become involved in a divorce, or any type of legal proceeding, certain information must be exchanged between the parties upon request. This process, which is commonly referred to as “discovery,” ensures that both sides to a dispute have equal access to all information that is relevant to the dispute so that each can adequately prepare for trial.

One tool that attorneys often use in court cases is the deposition. When a party is requested to appear for a deposition, he or she typically must appear at a certain time and place for questioning by the other side’s attorney. These proceedings often take place at an attorney’s office. A deposition always has a court reporter present to record and later transcribe the proceedings, as well as the attorneys for both sides, and the parties. In a deposition, you are placed under oath and must answer questions that are relevant to your divorce. When the other side’s attorney is done asking questions, your own attorney may ask you additional questions in order to clarify or expand upon your answers to previous questions. The purpose of a deposition is often to determine how an individual will testify at trial, and what sort of responses he or she has to certain kinds of questions.
