Alternative dispute resolution (ADR) consists of different techniques that are used to settle divorce or other family law proceedings without proceeding to trial. This process often allows parties to effectively resolve their differences and reach a settlement that is agreeable to both parties. Plus, in many counties in Georgia, parties to a contested or disputed family law proceeding may be required to engage in ADR and attempt to settle the case before proceeding to a trial before the judge.

During mediation, both parties and their attorneys meet with a neutral, third-party mediator whose role is to assist the parties in reaching a settlement as to all disputed issues. The mediator does not makes decisions for the parties or force them into an agreement; rather, the mediator just makes recommendations and gives advice to the parties in an attempt to resolve their issues. If the parties are able to reach an agreement, then the court is likely to approve their agreement, thereby resolving the matter. Reaching a settlement through mediation is not only significantly cheaper than proceeding to trial, but it also can encourage an earlier resolution of your issues and decrease the amount of stress that both parties experience.
